These Terms set out the conditions that apply when a User uses the "Fight Addiction" service (the "Service"). Please use the Service only after agreeing to these Terms.
Article 1 (Definitions)
The terms used in these Terms are defined as follows.
- Service: the service operated by us and related services.
- Site: the website on which the content of the Service is published.
- Content: the collective term for text, sound, still images, video, software programs, code, and the like provided on the Service (including Posted Information).
- User: any person who uses the Service.
- Registered User: a person who has completed user registration for the Service.
- ID: the unique string held by a Registered User for using the Service.
- Password: the unique code set by a Registered User corresponding to their ID.
- Posting: the act by which a Registered User publishes rankings, text, strings, images, comments, and the like.
- Posted Information: the collective term for rankings, text, strings, images, comments, and other information published by a Registered User through Posting.
- Personal Information: the collective term for information that can identify an individual, such as address, name, occupation, and telephone number.
- Registration Information: the collective term for information registered by a Registered User on the Service (excluding Posted Information).
- Intellectual Property: inventions, devices, new plant varieties, designs, works of authorship, and other products of human creative activity (including discovered or elucidated laws or phenomena of nature that have industrial applicability), trademarks, trade names, and other indications of goods or services used in business activities, as well as trade secrets and other technical or business information useful in business activities.
- Intellectual Property Rights: patent rights, utility model rights, breeder’s rights, design rights, copyrights, trademark rights, and other rights established by law with respect to Intellectual Property, or rights relating to legally protected interests.
Article 2 (Agreement to these Terms)
- The User may use the Service only after agreeing to these Terms of Service.
- A usage agreement under the provisions of these Terms is formed between the User and us at the point the User downloads the Service to a smartphone or other information device and completes the procedure for agreeing to these Terms.
- If the User is a minor, please use the Service only after obtaining the consent of a parent or other legal representative.
- If a minor User uses the Service by falsely claiming to have the consent of a legal representative when they do not, or by falsely claiming to be an adult with respect to their age, or by otherwise using deception to make others believe they have legal capacity, no legal act relating to the Service may be rescinded.
- If a User who was a minor at the time of agreeing to these Terms uses the Service after reaching adulthood, that User is deemed to have ratified all legal acts relating to the Service.
Article 3 (Changes to the Terms)
- We may revise the content of these Terms at any time without the consent of the User, and the User agrees to this without objection.
- When we revise these Terms, we will notify Users of the content by the method prescribed by us.
- The revision of these Terms takes effect from the time we give notice under the preceding paragraph.
- The User is deemed to have agreed without objection to the revised Terms of Service at the point they use the Service after the change to these Terms.
Article 4 (Account Management)
- The User shall register and manage, at their own responsibility, the information registered upon use (the "Registration Information", including email address, ID, and password). The User shall not allow a third party to use it, or lend, transfer, change the name of, or trade it.
- If the Service is used with the Registration Information, we may treat it as having been used by the person who performed the user registration, and all results and responsibility arising from such use shall belong to that person.
- If damage arises to us or a third party due to unauthorized use of the Registration Information, the User shall compensate us and the third party for such damage.
- Management of the Registration Information shall be carried out by the User at their own responsibility, and we shall not be liable for any disadvantage or damage suffered by the User due to inaccurate or false Registration Information.
- We may delete, without prior notice to the User, any account and its associated data that has not been accessed for one year or more.
- All of the User’s usage rights on the Service lapse when the account is deleted, for any reason. Please note that even if the User deletes the account by mistake, the account cannot be restored.
- The Service account belongs exclusively to the User. None of the User’s usage rights on the Service may be transferred, lent, otherwise disposed of, or inherited by a third party.
- If it becomes clear that the Registration Information has been stolen or is being used by a third party, the User shall immediately notify us and follow our instructions.
Article 5 (Handling of Personal Information)
Personal Information and User information will be handled appropriately in accordance with the "Privacy Policy" separately established by us.
Article 6 (Prohibited Acts)
In using the Service, we prohibit the User from the following acts. If we determine that the User has violated a prohibited item, we may take measures we deem necessary, such as suspension of use or deletion of posts, and the User agrees to this without objection.
- Acts that infringe the Intellectual Property Rights of us or a third party.
- Acts that damage the reputation or credit of, or that unfairly discriminate against or defame, us or a third party.
- Acts that infringe, or risk infringing, the property of us or a third party.
- Acts that cause economic damage to us or a third party.
- Threatening acts against us or a third party.
- Posting the following information by the User: (1) information that risks causing damage to the rights and property of a third party; (2) information harmful to a third party, or that physically or psychologically harms a third party; (3) information relating to crimes, illegal acts, or dangerous acts, and information that instigates or abets them; (4) information with content intended to, or that risks resulting in, illegality, harm, threats, abuse, racial discrimination, defamation, libel, insult, harassment, incitement, or offense; (5) information that is contrary to fact or known not to exist; (6) information for which the User does not hold controllable rights; (7) information that infringes intellectual property rights, including third-party copyrights, or other property rights, or that infringes the public interest or individual rights; (8) images, documents, or other information that constitute obscenity, child pornography, or child abuse; (9) information that violates laws such as the Medical Practitioners Act; (10) other information we deem inappropriate.
- Acts that use or induce computer viruses or harmful programs.
- Acts that place excessive stress on the infrastructure equipment for the Service.
- Attacks on the servers, systems, or security of the Site.
- Acts that attempt to access the Service by methods other than the interface we provide.
- Acts by which a single User obtains multiple User IDs.
- Acts that interfere with the servers or network systems of the Service.
- Acts that fraudulently operate the Service using bots, cheat tools, or other technical means.
- Acts that intentionally exploit defects in the Service.
- Acts that make unreasonable inquiries or demands to us, such as repeating similar questions more than necessary.
- Other acts that interfere with or impede our operation of the Service or other Users’ use of the Service.
- In addition to the above, acts we deem inappropriate.
Article 7 (Handling of Content)
- The User may use the Content of the Service only within the scope we prescribe.
- All rights to the Content provided on the Service belong to us, and we do not grant the User any implementation of, or license to use, our patent rights, utility model rights, design rights, trademark rights, copyrights, or other intellectual property rights.
- The User is prohibited from reproducing, transmitting, transferring (including trading between Users), lending, translating, adapting, reposting without permission, secondary use, use for commercial purposes, modifying, disassembling, decompiling, reverse engineering, or otherwise exceeding the scope of use we prescribe, by any method.
- Notwithstanding the preceding paragraph, if the User loses their user qualification due to withdrawal or the like, the right to use the provided Content also lapses.
- Copyright (including all copyrights, including the rights provided in Articles 21 to 28 of the Copyright Act) in Content that the User transmits by Posting or other means on the Service (still images, video, text information, and any other information) belongs to the User. However, upon transmitting the Content, the User grants us a free, non-exclusive license to use such Content within and outside Japan.
- The User shall not exercise moral rights of authorship within the Service.
- The User is responsible for backing up their own Posted Content. We are under no obligation to back up Posted Content.
Article 8 (Disclaimer)
- We are not liable for any damage arising from changes to, suspension of, or termination of the content of the Service.
- We are not involved in, and are not liable for, the User’s environment for using the Service.
- We make no warranty that the Service conforms to the User’s particular purpose, has the expected functions, commercial value, accuracy, or usefulness, that the User’s use of the Service conforms to laws applicable to the User or to internal rules of industry bodies, or that no defects will occur.
- We do not warrant that the Service supports all information devices, and the User agrees in advance that defects may occur in the operation of the Service due to OS version upgrades of the information device used for the Service. We do not warrant that any such defects will be resolved by program corrections we make.
- The User agrees in advance that use of part or all of the Service may be restricted in connection with changes to the terms of service or operational policies of service stores such as the App Store and Google Play.
- We are not liable to compensate for any damage arising to the User directly or indirectly from using the Service.
- We are not liable for any lost opportunity, business interruption, or other damage (including indirect damage and lost profits) arising to the User or any third party, even if we were notified in advance of the possibility of such damage.
- When another User or a third party requests deletion of a post, we may decide at our discretion whether to delete it, and we are not liable for any responsibility arising from such decision.
- The provisions of the first through preceding paragraphs do not apply where we acted with willful intent or gross negligence, or where the contract constitutes a consumer contract under the Consumer Contract Act.
- Even where the preceding paragraph applies, we are not liable to compensate, of the damage arising to the User due to negligent acts (excluding gross negligence), for damage arising from special circumstances.
- Where we are liable to compensate for damage in connection with use of the Service, our liability is limited to the amount received from the User in the month in which the damage occurred.
- We are not liable for any disputes or troubles between the User and other Users. Even if trouble arises between the User and another User, it shall be resolved at the responsibility of both parties, and no claim shall be made against us.
- If, in connection with use of the Service, the User causes damage to another User or a dispute arises with a third party, the User shall compensate for such damage or resolve such dispute at their own cost and responsibility, and shall not cause any nuisance or damage to us.
- If we are subject to a claim for damages or the like from a third party due to the User’s acts, the User shall resolve it at their own cost (including attorney’s fees) and responsibility. If we pay damages to such third party, the User shall pay us all costs including such damages (including attorney’s fees and lost profits).
- If the User causes damage to us in connection with use of the Service, the User shall compensate us for the damage (including litigation costs and attorney’s fees) at their own cost and responsibility.
- We do not warrant the accuracy of information posted by other Users on the Service. We are not liable for any disputes or troubles concerning information published on the Service.
- We do not warrant, expressly or implicitly, that the Service (including the Content) is free of defects (including defects in security, errors, bugs, and rights infringements), nor its safety, reliability, accuracy, completeness, effectiveness, or fitness for a particular purpose. We are under no obligation to provide the Service with such defects removed.
Article 9 (Advertising)
The User is deemed to understand and agree that the Service may contain any advertisements, and that we or our partners may place any advertisements. The form and scope of advertisements on the Service may be changed by us from time to time.
Article 10 (Prohibition of Assignment of Rights)
- Unless the User obtains our prior written consent, the User shall not assign to a third party all or part of their status under these Terms, or their rights or obligations under these Terms.
- We may assign all or part of the Service to a third party at our discretion, in which case, within the scope of the assigned rights, all of the User’s rights relating to the Service, including their account, shall transfer to the assignee.
Article 11 (Severability)
Even if any provision of these Terms, or any part thereof, is held invalid or unenforceable under the Consumer Contract Act or other laws, the remaining provisions of these Terms and the remaining part of any provision held partly invalid or unenforceable shall continue in full force and effect.
Article 12 (How to Contact Us)
The User shall contact us or make inquiries regarding the Service by submitting through an inquiry form placed at an appropriate location within the Service or a website we operate, or by another method we separately designate.
Article 13 (Governing Law)
We will review the operational status of the handling of personal information from time to time, strive for continuous improvement, and may change this Privacy Policy as necessary.
